Important Notice

TruRate operates as a marketplace platform. We do not lend money, handle funds, or set interest rates. We facilitate connections between borrowers and independent lenders who set their own terms and conditions.

1. Acceptance of Terms

By accessing or using TruRate ("the Platform"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services.

2. Nature of Service - Marketplace Only

TruRate operates exclusively as a marketplace platform that:

  • Provides a platform for lenders to list their loan offers
  • Allows borrowers to browse available loan offers
  • Facilitates initial contact between borrowers and lenders
  • Displays Trust Points from TrustClub for personalized rate calculations

TruRate DOES NOT:

  • Lend money or provide any financial services
  • Handle, transfer, or hold any funds
  • Set, control, or influence interest rates
  • Guarantee loan approval or availability
  • Act as a financial institution or intermediary
  • Provide financial, legal, or investment advice
  • Verify the accuracy of lender information
  • Guarantee the legitimacy or solvency of any lender

3. Lender Independence

All lenders on the Platform are independent entities who:

  • Set their own interest rates and loan terms
  • Determine their own lending criteria
  • Make their own decisions about loan approvals
  • Are solely responsible for their lending activities
  • Must comply with all applicable laws and regulations

Lenders can offer any rates and terms they choose. TruRate has no control over these offerings.

4. User Responsibilities

As a Borrower:

  • You are responsible for evaluating all loan offers
  • You must verify lender credentials independently
  • You should understand all terms before accepting any loan
  • You are responsible for repaying any loans you accept
  • You should report suspicious activity to authorities

As a Lender:

  • You must comply with all applicable lending laws
  • You are responsible for your own due diligence
  • You set your own rates and terms
  • You handle all funds and transactions independently
  • You must provide accurate information in your listings

5. No Financial Transactions on Platform

NO MONEY CHANGES HANDS THROUGH TRURATE. All financial transactions, including loan disbursements and repayments, occur directly between borrowers and lenders outside of our Platform. We do not process, handle, or have access to any funds.

6. Trust Points and TrustClub

Trust Points are provided by TrustClub, an independent third-party service. These points are displayed for informational purposes only. Lenders may choose to use Trust Points to offer different rates, but this is entirely at their discretion. TruRate does not control or verify Trust Points.

7. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE SPECIFICALLY DISCLAIM:

  • The accuracy, reliability, or completeness of lender information
  • The availability or terms of any loans
  • The creditworthiness or legitimacy of any user
  • The legality of any lending activities
  • The success of any loan transaction

8. Limitation of Liability

TRURATE SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING FROM:

  • Any loan transaction or failed transaction
  • Actions or inactions of any lender or borrower
  • Financial losses of any kind
  • Fraudulent or illegal activities by users
  • Disputes between borrowers and lenders
  • Inaccurate information provided by users
  • Your use or inability to use the Platform

9. Indemnification

You agree to indemnify and hold harmless TruRate, its operators, and affiliates from any claims, losses, damages, or expenses arising from your use of the Platform, your violation of these Terms, or your lending or borrowing activities.

10. Risk Acknowledgment

Peer-to-peer lending involves inherent risks that users should consider, including: potential loss of funds, borrower default risk, possibility of fraudulent activity, regulatory compliance considerations, and no guaranteed returns on loans. Users participate at their own risk and should conduct appropriate due diligence.

11. Prohibited Activities

Users may not:

  • Use the Platform for illegal activities
  • Provide false or misleading information
  • Engage in money laundering or fraud
  • Violate any applicable laws or regulations
  • Harass or harm other users
  • Attempt to manipulate Trust Points
  • Scrape or misuse Platform data

12. Account Termination

We reserve the right to terminate or suspend any account at our sole discretion, without notice, for any reason including violation of these Terms.

13. Dispute Resolution

Disputes between borrowers and lenders must be resolved directly between the parties. TruRate is not responsible for mediating, arbitrating, or resolving any disputes.

14. Governing Law

These Terms shall be governed by the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England.

15. Changes to Terms

We may modify these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the modified Terms.
